      0. Approval from the community of owners

      This step has been in force since April 2025, and if the property is located within a community of owners, it is necessary to obtain approval for tourist rental by at least 60% of the owners. It’s very difficult.

      First of all, it is necessary to check whether the property can obtain a tourist license.

      Not all homes can have a tourist license in Alicante.

      Therefore, it is much better to know in advance before starting the formal management. This process involves the preparation of reports, payment of fees, and presentation of documents. In other words, with the previous study, we can avoid these unnecessary costs.

      We recommend being cautious with companies that offer tourist licenses and suggest skipping this step.

      2. Certificate of habitability

      As for the second step, it is necessary at the time of the application for the house to have a valid habitability certificate. If not, such a license would have to be obtained.

      3. Obtaining the compatibility report from the town hall.

      This document is essential for tourism as it enables them to grant you the license. It states that your property is compatible with the tourist license according to the territorial regulations.

      4. Registration in Tourism for a tourist licence

          DOCUMENTATION REQUIRED FOR THE MUNICIPALITY

          Plans of the premises:

          It is necessary to include plans of the establishment where the dimensions, internal distribution and the areas destined to different activities, such as the customer service area, storage, toilets, etc.

          Application form:

          You must complete and submit the corresponding application form.. You can obtain it from the City Council or download it from their official website.

          Urban development compatibility report::

          You may need to obtain a town planning compatibility certificate, which verifies that the activity is suitable for the area in which the premises are located.

          DNI or CIF:

          This means that you must provide identification documentation, deeds or a lease contract. If you are the owner of the business premises, you must provide a copy of the deeds. On the other hand, if you are a tenant, you must present the lease contract for the premises.

          Activity project:

          It has to be drawn up by a competent technician, such as an architect or engineer, detailing aspects such as electrical installation, plumbing and air conditioning, among other things.

          Acoustic study:

          In some activities it is necessary to verify the correct acoustic insulation of the premises.

          Electrical OCA:

          Necessary to check that the electrical installation complies with the regulations.

          Proof of fees:

          As with any other procedure with local councils, it is always necessary to justify that the corresponding fees have been paid.

          Other documents:

          Depending on the activity, other additional documents may be required, such as sector licences or specific authorisations (for example, in the case of activities related to food or the environment).

          What is the licence of second occupation?

          The second occupancy licence or second occupancy certificate is a technical document that certifies that a second-hand property has the characteristics and conditions to be habitable.

            SIMPLE NOTE

            Finally, we have the nota simple (simple note) that represents the main data of the property. It contains the details of the owner, square metres, address of the property, etc.

            On many occasions when the second occupancy licence is issued, this document is still being processed and we do not have it yet. Because it usually takes 2 to 3 months.

            SECOND HOME OCCUPANCY REQUIREMENTS

            The most important requirement to obtain this license is that the housing is habitable.

            What does this mean?

            It must have: Minimum usable area of 24 square meters, hot water supply (ACS), kitchen with smoke extraction, smoke ventilation, etc.

            They are usually confused, but they are not exactly the same.

            The cédula de habitabilidad certifies the habitability of a newly constructed property. It is also called a licence of first occupation.

            The second occupancy licence (also called cédula de segunda habitabilidad) certifies the habitability of a property already in use (hence the distinction of “second”), with respect to the cases in the previous section of this post.

            You will have to communicate it to the town hall, through the same procedure as the second occupancy licence. But without making the technical report.
